General Terms And Conditions Munchies Food Tour


1. Definitions:
Munchies Food Tour: Organizer of specialised Food Tours; registered place of business at Vier
Heemskinderenstraat 44-3, 1055 LL Amsterdam, The Netherlands, registered
with the Chamber of Commerce of Amsterdam under number 74631306,
hereafter referred to as ‘MFT’.

Food Tour: Specialised guided Food Tour through the city centre.
Guide: The person conducting the Food Tour on behalf of MFT.
Participant: The participant of the Food Tour organised and provided by MFT.
Parties: MFT and Participant will be jointly referred to as ‘Parties’.


2. General
2.1. These General Terms and Conditions and any associated agreements between Parties shall
be governed by the laws of the Netherlands. Parties agree to submit to the exclusive
jurisdiction of the authorised courts of Amsterdam with respect to any dispute arising from
or in accordance with the Food Tour or the performance of MFT or the Participant.
2.2. These General Terms and Conditions apply to all bookings with and services of MFT.
2.3. As the Food Tour might include some explicit content, Participants must be at least 18 years
old on the scheduled date of the Food Tour. MFT reserves the right to request proof of age
before the start of the Food Tour.
2.4. All Participants should read and take notice of these General Terms and Conditions.
2.5. All Participants are bound by these General Terms and Conditions by booking a Food Tour
with MFT.
2.6. Should any Participant book a Food Tour for other Participants (booking for a group), then it
is the responsibility of this Participant to pass on these General Terms and Conditions to the
other Participants and make sure that the other Participants take notice of these General
Terms and Conditions.
2.7. Each of the terms in these General Terms and Conditions are severable and distinct from one
another. If at any time any term should become invalid, illegal or unenforceable, the validity,
legality or enforceability of the other terms shall not in any way be affected or impaired.
2.8. Nothing in these General Terms and Conditions shall confer on any third party any benefit or
the right to enforce any provision of these terms.


3. Services
3.1. MFT organises and provides specialised guided Food Tours for Participants through the city
centre.
3.2. MFT reserves the right to adjust the content and the route of the Food Tour along the way,
should circumstances arise. Adjustments will be minor and always in line with the idea
behind the original tour.

4. Booking Procedure
4.1. Participants can book a Food Tour up to 6 months in advance through the website
www.munchiesfoodtour.com . Bookings can be made until 2 hours before the start of the
Food Tour.
4.2. All quoted prices will be in Euro’s including VAT.
4.3. Participants will provide the following information upon booking: name, nationality, phone
number, e-mail address, address of the accommodation in the Netherlands, number of
Participants (booking for a group).
4.4. After providing the information as described in section 4.3, Participants will be directed to
the payment page. All Payments need to be done at the moment of booking by credit card or
by PayPal or by any other electronic method of payment available at the time.
4.5. As soon as the payment has been received by MFT, Participants will receive a booking
confirmation by e-mail. This booking confirmation also provides information of the meeting
point for the start of the Food Tour. Participants need to show the booking confirmation at
the start of the Food Tour as proof of the booking.


5. Cancellation
5.1. If MFT cannot provide the Food Tour due to circumstances beyond control, such as, but not
limited to, adverse weather conditions or orders from the local government, MFT will offer
an alternative date for the Food Tour. If Participant is not available on this alternative date,
MFT shall provide a full refund of the payment to Participant.
5.2. If Participant cancels the booking of the Food Tour at least 14 days before the start of the
Food Tour, MFT shall provide a full refund of the payment to Participant.
5.3 If Participant cancels the booking of the Food Tour in less that 14 days before the start of the
Food Tour, MFT shall provide a 50% refund of the payment to Participant.
5.4 If Participant cancels the booking of the Food Tour within 7 days of the start of the Food
Tour or does not show up at the start of the Food Tour (no-show), Participant will not be
eligible for a refund.


6. Obligations of the Participant
6.1. Participant confirms that he will be at least 18 years old when participating in the Food Tour.
6.2. Participant acknowledges that he will participate in a Food Tour and confirms that he is in
good health and able to walk a reasonable distance.
6.3. Participant will inform MFT about any kind of allergies during booking.
6.4. Participant should be aware of the local rules and regulations applicable for pedestrians.
6.5. Participant must follow and abide with all reasonable instructions from MFT.
6.6. Participant must refrain from:
6.6.1. the consumption of alcoholic beverages, unless during scheduled breaks on the Food
Tour;
6.6.2. the consumption or transportation of recreational (hard) drugs;
6.6.3. any display of aggressive behaviour, harassment, threats or otherwise improper
conduct towards the Guide, the persons who are being interviewed during the Food
Tour, other Participants or any other person who is not associated with the Food
Tour;
6.6.4. hindering the Guide or MFT in any way from performing their obligations.

7. Liability disclaimer
7.1. MFT or the Guide do not encourage the use of cannabis products or provide any kind of
cannabis products, before, during or after the Food Tour.
7.2. MFT or the Guide are not in any way responsible for any actions of Participant in relation to
the consumption of any kind of cannabis products, before, during or after the Food Tour.
7.3 If Participant decides to consume any kind of cannabis products, before, during or after the
Food Tour, that is the sole responsibility of Participant.
7.4. If Participant cannot continue the Food Tour, due to the consumption of cannabis products,
the Guide will ensure Participant is in a safe location and continue the Food Tour without
Participant. A no refund policy applies in this situation. 
7.5. Participant hereby releases and discharges MFT, its officers, employees and board, jointly
and severally, from any and all actions, claims and demands for, upon or by reason of any
damages, losses or injuries, which may be sustained by participating in the Food Tour. This
release extends and applies to, and also covers and includes, all unknown, unforeseen,
unanticipated and unsuspected damages, losses or injuries, liability and the consequences
thereof, as well as those now disclosed and known to exist.


8. Personal data and privacy
8.1. Personal data as provided by Participant will be processed by MFT according to the EU
2016/679 regulations.
8.2. Personal data will only be used for the execution of the agreement between Parties.
8.3. Personal data will not be used for (direct) mailing, unless Participant gives his express
approval. Personal data will not be shared with third parties.
8.4. MFT reserves the right to take photographs and videos during the Food Tour for commercial
purposes. These photographs and videos could show Participants identifiable. If Participant
does not want MFT to use a photograph or video showing Participant, Participant shall send
an e-mail to hello@munchiesfoodtour.com and specify the relevant photograph or video.
Upon request of Participant, MFT will stop using this specific photograph or video for
commercial purposes.


9. Complaints
9.1. Any complaints before, during or after the Food Tour should immediately be brought to the
attention of the Guide. The Guide will then try to resolve the complaint.
9.2. If a complaint cannot be solved by the Guide or to the satisfaction of the Participant,
Participant can send an e-mail to hello@munchiesfoodtour.com within 14 days after
participation of the Food Tour to inform MFT about the complaint. MFT will then, at its sole
discretion, decide if the complaint is valid and if so, what kind of compensation will be
provided to the Participant.
9.3. In the event that a complaint cannot be amicable settled, Participant may refer the dispute
to the authorised courts of Amsterdam.
